Child Custody Attorneys In Monmouth County

When parents in New Jersey end their marriage or a nonmarital relationship, decisions about custody of minor children and parenting plans often become the main focal point. If parents can reach an agreement in this area, the court will approve the plan as long as it is in the best interests of the child.

If the parents cannot reach an agreement, the court will award custody and designate a visitation schedule. The court considers several factors in making these decisions, including:

  • Each parent’s ability, physically and mentally, to accept custody of the child
  • Each parent’s ability to agree, communicate and cooperate in matters pertaining to the child
  • The stability of the home environment
  • The child’s relationship with each parent
  • The interaction of the child with his or her parents and siblings
  • The quality of the child’s education
  • The geographical proximity of the parents’ homes
  • The preferences of the child if the child is deemed to be of sufficient age and capacity to form an intelligent decision

We Protect Your Parental Rights

The attorneys at Deitch & Perone, P.C., understand your concerns about maintaining a strong relationship with your child. We will work to ensure that you receive ample time to maintain that bond, whether you expect to be the custodial parent, share custody equally or work out a visitation plan.

A significant life event may trigger the need to modify child custody, child support or spousal support. We represent clients in modification cases and defend against petitions to modify support.

In determining child custody, the courts will designate legal custody and physical custody. Legal custody refers to the authority to make decisions regarding the child’s education, health, religion and other major issues. Often, the courts award joint legal custody so that both parents have an equal say.

Physical custody refers to where the child will spend the majority of days and nights. If a child spends more than two nights per week with each parent, it is referred to as shared physical custody. The number of nights that a child spends with each parent often directly impacts child support decisions.

When parents reach an agreement on a custody arrangement without litigating, they generally retain more control over the plan that is put in place. We know, however, that not every custody dispute can be resolved amicably. We advocate aggressively for our clients during negotiations as well as in court on custody and all other family law matters.
